Airlabs Limited – Product Warranty terms

Airlabs Limited (“AirLabs”) warrants that each AirBubbl or AirHavn Pro (“Product”) purchased from AirLabs shall be free from defects in materials and workmanship under normal use for a period of two (2) years from the date of purchase (“Warranty Period”). AirLabs also gives this warranty in respect of AirBubbl and AirHavn Pro Products only supplied by an authorized reseller or agent.

AirLabs does not warrant that the operation of the Product will be uninterrupted or error-free. AirLabs is not responsible for damage arising from failure to follow usage instructions.

Remedies

If a valid claim is received by AirLabs within the Warranty Period, AirLabs will either:

(1) repair the Product at no charge, using new or refurbished replacement parts; or
(2) replace the Product with a new or refurbished Product.

These are your sole and exclusive remedies under this Warranty but do not affect your statutory rights.

Shipping and handling charges may apply (except where prohibited by applicable law).

Any replacement Product will be warranted for the remainder of the original Warranty Period or thirty (30) days, whichever is longer.

How to Obtain Warranty Service

To claim under this Warranty, you must deliver the Product, in either its original packaging or packaging providing an equal degree of protection, to the address specified by AirLabs (or the AirLabs authorised reseller from whom you purchased it).

AirLabs may require that you furnish proof of purchase and/or register this Warranty before making a claim under it. It is your responsibility to back-up any data, software, or other materials you have stored on the Product as it is likely that such data, software, or other materials will be lost or reformatted repair and AirLabs will not be responsible for any such damage or
loss.

Exclusions and Limitations

This Warranty applies only to Products manufactured by or for AirLabs as identified by the “airbubbl” or ‘airhavn’ trademark, trade name, or logo affixed to it.

The Warranty does not apply to any (a) AirLabs products and services other than the Product, (b) non-AirLabs hardware product, or (c) consumables (such as batteries) and accessories.

This Warranty does not apply to a Product or part of the Product that has been altered or modified (e.g., to alter functionality or capability) by anyone who is not a representative of AirLabs or if the Product is inserted or installed in a casing not provided by AirLabs. In addition, this Warranty does not apply: (a) to damage caused by use with non-AirLabs products; (b) to damage caused by accident, abuse, misuse, flood, fire, earthquake or other external causes; (c) to damage caused by operating the Product outside the permitted or intended uses described by AirLabs or with improper voltage or power supply; or (d) to damage caused by service (including upgrades and expansions) performed by anyone who is not an authorised representative of AirLabs.

No AirLabs reseller, agent, or employee is authorized to make any modification, extension, or addition to this Warranty.

If any term of this Warranty is held to be illegal or unenforceable, the legality or enforceability of the remaining terms shall not be affected or impaired.

Law and Jurisdiction
This Warranty is to be interpreted in accordance with English law and you can bring legal proceedings in respect of it in the English courts. If you are a consumer and you live in Scotland you can bring legal proceedings in respect of the products in either the Scottish or the English courts. If you are a consumer and you live in Northern Ireland you can bring legal proceedings in either the Northern Irish or the English courts.
